Arts and Culture Trust Privacy Policy

The Arts and Culture Trust (ACT WA) complies with the Privacy and Responsible Information Sharing Act 2024 (WA) (PRIS Act). This means ACT WA adheres to the Information Privacy Principles (IPPs) when handling your personal information.

ACT WA recognises the importance of protecting the privacy of personal information and sensitive information collected in a number of ways including:

  • from publicly available sources of information;
  • when you visit our website and / or via software, such as cookies and web or tracking pixels;
  • from you directly;
  • from third parties;
  • from our own records at ACT WA; and
  • when legally required to do so.

Personal Information and Sensitive Information

Personal Information refers to information or an opinion about an identified individual or an individual who is reasonably identifiable.

Sensitive information Refers to a subset of personal information, which includes information or an opinion about an individual’s health, genetics, race, ethnicity, political opinion or association, religion, philosophical beliefs, union membership, sexual preference, and criminal record.

Kinds of information held and collected by Arts and Culture Trust

Personal information held by ACT WA is collected only when knowingly and voluntarily submitted by you.

When you register your interest or otherwise engage with ACT WA services, ACT WA may collect personal information including:

  • your name, address and contact details
  • photographs, video recordings and audio recordings
  • voice print and facial recognition biometrics
  • location information from a mobile device
  • information recorded by the ACT WA webserver when an individual visits the ACT WA website, including the individual’s:
    • server address
    • top level domain name (e.g. .com, .au, .gov)
    • the date and the time of the visit to the site
    • the pages accessed and downloaded
    • the address of the last site visited
    • operating system
    • the type of browser in use

Sensitive information held by ACT WA is collected only when knowingly and voluntarily submitted by you. Although ACT WA will rarely hold and/or collect this kind of information, the information held may include your racial or ethnic background, your family status and/or financial information about you, such as your tax file number. At all times, ACT WA will take reasonable steps to obtain your express consent where we propose to handle your sensitive information.

Collecting information from you

Generally:

  • ACT WA will tell you why and when we are collecting information and how ACT WA plans to use it or these things will be obvious when the information is collected; and
  • ACT WA will only use your personal information if and when ACT WA needs to contact you.

For example, ACT WA may collect personal information to provide services, respond to enquiries, or administer its functions. ACT WA is committed to ensuring personal information is handled in accordance with applicable privacy laws and obligations.

If you choose not to provide personal information to ACT WA, we may not be able to provide you with access to the parts of this Site or to certain content, products and services available on or from this Site or generally from ACT WA.

Use of Information

Purpose of collecting and holding information

ACT WA uses personal information to provide services and perform administrative functions associated with those services.

Personal information is used only for the purpose for which it is submitted or for such other secondary purposes that are related to that purpose, unless ACT WA disclose other uses in this Privacy Policy or at the time of collection.

Primary purpose refers to the particular purpose for which the information in question was collected. For example, if ACT WA were to provide you with a newsletter and ACT WA asked for your address to send it to you, the primary purpose for the collection for your address would be to send the newsletter to you at your address.

Secondary purpose is any purpose other than the primary purpose for which ACT WA collected your personal information.

Personal information will only be used or disclosed for a secondary purpose where permitted by the Privacy and Responsible Information Sharing Act 2024 (WA), the Information Privacy Principles (IPPs), or another applicable law, including where:

  • the individual has consented;
  • the use or disclosure is authorised or required by law;
  • the use or disclosure is directly related to the purpose for which the information was collected; or
  • another lawful basis for use or disclosure applies.

ACT WA may collect personal information such as your name, address, telephone number and, in some instances, business details. ACT WA may collect website usage information, including pages visited, links selected and IP address information. ACT WA does not generally collect sensitive information. Where ACT WA collects sensitive information, it will do so in accordance with the IPPs and, where required by law, with the individual's consent.

If you subscribe to receive promotional or other material from ACT WA or are registered for any services, then your personal information that you provide will be recorded. Your email address will only be used for the purpose for which you have provided it (which may include being added to ACT WA mailing list, and in the instance when ACT WA are delivering a project in partnership with another company it may also include being added to the partner's mailing list for that particular project but otherwise it will not be added to any other mailing lists.

Parties who will have access to personal information

Personal information is only accessed by ACT WA employees, officers and authorised persons where required to perform their duties.

However, your personal information may also be accessed, from time to time, by various organisations.

Where ACT WA discloses personal information to contractors, service providers, project partners or other third parties, ACT WA takes reasonable steps to ensure appropriate privacy, confidentiality and security arrangements are in place.

Use of Aggregate Data

ACT WA may use aggregated and de-identified information to improve services and better understand customer and community needs. This statistical compilation and analysis of information may also be used by ACT WA or provided to others as a summary report for marketing, advertising or research purposes.

Period for which records are held and Information Retention and Destruction Practices

ACT WA maintains processes for the retention and disposal of records containing personal information. ACT WA periodically reviews records containing personal information to ensure they are retained only as long as required. Where records containing personal information have been retained for an extended period, ACT WA will take reasonable steps to determine whether the information should be retained or securely disposed of in accordance with applicable requirements.

Anonymity or pseudonyms

Where ACT WA uses personal information for statistical or marketing purposes, ACT WA will endeavour to use pseudonyms or de-identify any personal information.

Holding personal and sensitive information and security

Holding information securely

ACT WA takes reasonable steps to protect the security, integrity and privacy of personal and sensitive information. ACT WA uses a variety of physical and electronic security measures including restricting physical access to ACT WA offices and firewalls and secure databases to keep personal information secure from misuse, loss or unauthorised use or disclosure. In relation to personal information provided through our website, unfortunately, no data transmission over the Internet can be guaranteed to be totally secure.

Receipt of unsolicited personal information

Unsolicited personal information is personal information that ACT WA receives where ACT WA has not actively sought to collect the information.

When ACT WA receives unsolicited personal information, ACT WA will assess whether it is appropriate and lawful to retain the information. Where the information is not required for ACT WA functions or activities, ACT WA will take reasonable steps to destroy or de-identify the information as soon as practicable, where lawful and reasonable to do so.

Accessing and correcting Personal Information

Accessing personal information

You have a right to access the personal information ACT WA hold about you and if a request to access is denied, ACT WA will tell you why.

You may request access to your personal information in accordance with applicable privacy legislation and the Freedom of Information Act 1992 (WA).  Should you experience difficulty in determining the correct route by which to request access to your personal information, please contact ACT WA for assistance.

We reserve the right to charge a fee for locating and providing you with your personal information.

Correction personal information

You have a right to request the correction and/or amendment of your personal information. Applications to have personal information held by ACT WA corrected or amended should provide current contact details and enough information to determine what changes are required. Cookies

A cookie is a small text file stored on your computer’s browser. Many cookies from websites will be visible from your browser. ACT WA uses cookies to learn about the way you interact with ACT WA’s content and to help improve your experience when visiting ACT WA’s website, including storing information related to your cart contents, login status or other details relevant to your current user session.

  • ACT WA may record your visit through the use of cookies and may log the following information for purely statistical purposes:
  • your server address;
  • your to-level domain name (eg .com, .gov, .uk, etc);
  • the date and time of your visit to ACT WA’s site;
  • the pages accessed and documents downloaded by you;
  • the previous site(s) visited by you; and

ACT WA will not facilitate the merging of personally-identifiable information with non-personally identifiable information collected through any cookies, tracking / web pixels or Google advertising products or features, unless it has robust notice of and the relevant party’s consent to that merger.

ACT WA’s website also uses third-party cookies. These are cookies sent by businesses that provide content, such as advertising, on websites that you visit, and are businesses other than ACT WA. Third-party cookies are used on ACT WA’s website to enable remarketing and reporting for impression-assisted visits, website conversions, user demographics and user interests.

The third-party cookies used on ACT WA’s website include, but are not limited to, Google Analytics Advertising Features using Google advertising cookies, cookies from YouTube and the Facebook tracking or web pixel.

If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to deny or accept the cookie feature. You should note that cookies may be necessary to provide you with features and / or functions on this website and on other websites.

If you want to opt out of the operation of third-party cookies, such as those associated with Google Analytics Advertising Features, you will need to refer to the privacy policies of the relevant third-party websites. 

Information provided to you

Information contained in materials or products provided by ACT WA must not be used for direct marketing purposes or disclosed to any person or third party for direct marketing purposes without appropriate authority. ACT WA takes no responsibility for misuse of information obtained from material or products supplied by ACT WA, including through ACT WA's website.

Third Party

In relation to the use of ACT WA’s website, ACT WA may establish relationships with business partners that allow visitors to our website to link directly to sites operated by those partners. Some of these sites may be "co-branded" with ACT WA’s logo; however, these sites may not be operated or maintained by, or on our behalf of, ACT WA. These sites may collect personal information from you that may be shared with ACT WA. This Privacy Policy will apply to any personal information ACT WA obtains in this manner.

ACT WA is not responsible for the content or practices of websites operated by third parties that are linked to ACT WA’s website. These links are provided for the user’s convenience only. Links to third- party sites do not constitute sponsorship, endorsement or approval by ACT WA of the content, policies or practices of those third- party sites. Once you have left ACT WA’s website via such a link, you should check the applicable privacy policy of the relevant third- party site.

ACT WA may disclose personal information to contractors, service providers, partner organisations and other third parties where this is necessary to perform ACT WA’s functions, provide services, deliver programs, administer its website or meet legal obligations.

Where ACT WA discloses personal information to a third party, ACT WA will take reasonable steps to protect that information, including through appropriate privacy, confidentiality and security arrangements where relevant in place.

Equilibrium administers the public website on behalf of ACT WA, and logs visits to the website and records the following information for statistical purposes:

  • the user's server address;
  • the user's top level domain name (eg .com, .gov, .au, .uk etc.);
  • the date and time of the visit to the site;
  • the pages accessed and documents downloaded;
  • the object size;
  • the elements clicked on the site;
  • the transaction type;
  • the number of milliseconds that the transfer required;
  • the previous site visited;
  • the type of browser used;
  • browser capabilities;
  • connection speed; and
  • the operating system.

Information collected and held by third-party website administrators or service providers may be handled in accordance with Equilibrium is governed by its own privacy policies. ACT WA’s responsibility is to be transparent about when personal policy. may be disclosed to those third parties and to take reasonable steps to protect personal information that ACT WA discloses. ACT WA has taken steps, and will continue to take steps, to ensure that and/or Equilibrium complies with PRIS and the IPPs when collecting, holding or using personal information provided to it by ACT WA.

Social Media

When you browse and use ACT WA’s social media pages, such as Facebook, Instagram, X and YouTube, you are using an external site and are therefore subject to the privacy policies and practices of that site. If you have any questions or concerns regarding that site’s privacy policies and practices, you should review the privacy policy of the relevant site. ACT WA does not endorse, and is not accountable for, any views expressed by third parties using that site.

ACT WA records all information posted to its social media pages and uses that information for the purposes of administering the pages, for record keeping, for considering and / or addressing any comments made and for running competitions and campaigns. No attempt will be made to further identify social media subscribers except where requested and authorised by law.

Likely overseas disclosure

It is not standard practice for ACT WA to disclose personal information to overseas recipients. However, there is a possibility that, on occasion, your personal information may be disclosed to an overseas recipient. The location of any potential recipients will vary depending on the project or purpose concerned. Should you have any queries about the potential disclosure of your personal information to an overseas recipient, please contact the ACT WA Director Governance and Executive Services set out at the end of this document.

Cloud servers 

Indirect transfer of data, including personal information, may occur where ACT WA back up collected information on a cloud- based system provided by a third- party data storage provider, as ACT WA and the entities to which ACT WA discloses your personal information may, from time to time, utilise cloud-based computing services. In such cases, personal information may be transferred to hosting entities overseas. As a result, ACT WA will not enter into an arrangement to transfer such data unless the recipient has appropriate privacy, confidentiality and security arrangements policy meeting or exceeding the standard of stringency contained in this Privacy Policy.

There are some limited circumstances where if controls are in place to prevent the recipient from ‘controlling’ the personal information then a transfer may be deemed a ‘use’ rather than a disclosure.

Disclosure

ACT WA will disclose personal information when it permits that information to become known outside the organisation, and where it releases it from its effective control. For example, ACT WA would be said to have 'disclosed' your personal information where:

  • it shares that your personal information with another entity;
  • it publishes your personal information on the internet so that it is accessible by others;
  • where one of its staff reveals your personal information in the course of a conversation with a person who does not work for ACT WA; or
  • where one of its staffs sends a document containing your personal information to someone who is not you.

Personal information may also be disclosed where authorised or required by law, or where necessary to protect the rights, property or safety of ACT WA, its users or other persons.

Also, ACT WA may disclose personal information when ACT WA believe in good faith that the law requires disclosure.

Notification of Changes

ACT WA may update this Privacy Policy from time to time. Any changes will be published on ACT WA's website.
